Terms and Conditions of Sale

 

We've made our Terms and Conditions as easy and brief as possible as no one likes to read them, but by placing your order with 'us/we/our' (GIZMO-DEALS), you accept the following.

 

1. Prices
Our products and prices are subject to change. Promotional prices/offers only apply in the period stated for the promotion. Whilst we try to ensure that prices are accurate at all times, we are not responsible for errors that may occur. If we discover any errors in the price of goods before we accept your order, we will notify you as soon as possible and give you the option to resubmit your order at the correct price or cancel.

 

2. Availability
All goods and services are subject to availability. Any product stock or availability information supplied is an estimate only. If on receipt of your order the goods are not available in stock we will notify you, and offer to refund you for any sum that has been paid by you, or allow you to wait until available in stock.

 

3. Delivery
Charges for delivery may not be included in the product price and will be provided on checkout (before you submit your card details). Every effort is made to ensure a prompt despatch of your order and delivery within the stated delivery days. However, we will not be liable for any loss or damage suffered by you through reasonable or unavoidable delay in delivery. In this case, we will inform you as soon as possible. It is your responsibility to check all items ordered are included within the delivered consignment. It is your responsibility to notify us of any incorrect goods supplied within 7 days of delivery.

3.1 Delivery times.  All UK orders are sent by either next day courier or 1st class (1-2 business days estimated).  International orders are sent by Airmail (3 - 10 days estimated delivery).

 

4. Ordering
Any e-mail or other electronic acknowledgement by us of receipt of an order placed by you does not constitute legal acceptance by us of your order. All orders are subject to approval by us and your order is only accepted once we despatch. When processing your order, the information provided will be subject to credit and fraud prevention checks. Payment shall be due before the order is processed for despatch. Payment shall be a fundamental term of this agreement, breach of which shall entitle 'us' to terminate the contract immediately.

 

5. Returns and Refunds

 

5.1 Faulty Goods (within 6 months of despatch)
If your purchase develops a fault within 6 months of despatch, we will exchange, replace or refund the item. We will arrange for the item to be returned for testing, and then send you a new replacement straight away. Alternatively if proof can be provided by photographic or video evidence we can send a replacement without exchanging. This does not apply to faults caused by accident, neglect or misuse, for which there will be no exchange or repair.

 

5.2 Damaged Goods
In the unlikely event your order is received damaged please contact us immediately. Please retain the original packaging for returning your order. Contact us with your order number and with details of the problem. We will arrange to replace. It is your responsibility to notify us of any incorrect goods supplied within 7 days of delivery.

 

5.3 Unwanted Goods (within 60 days of receipt)
Provided your purchase remains unused and 'as new' we will accept the item back for a full refund up to 60 days after receipt without question. This refund does not extend to the original cost of delivery or return costs. The customer is responsible for the return of all goods. Your item will need to be inspected before reimbursement is made. To exercise your right to cancel, you must contact us prior to returning any goods.

 

5.3.1 Unwanted Goods (outside 60 days of receipt)
No goods are accepted outside of the 60 day returns policy.

 

6. Lost items
GIZMO-DEALS use mail services to despatch items to customers. UK items are sent via Royal Mail or courier, depending on order value. Foreign orders are sent Airmail. In the unlikely event that items do not arrive the buyer must allow 15 days (UK) and 21 days (outside UK) to establish the item as lost. After that period has expired the buyer must contact GIZMO-DEALS. 


7. Site Information
Any goods, services or information displayed should not be regarded as an offer, invitation, solicitation, advice or recommendation to buy products or services on the site. No warranties or representations are made about any goods other than as expressly contained in this site. To the extent permissible by law all implied terms, whether by statute or otherwise, are excluded. Product images are for illustrative purposes only and may differ from the actual product.

 

8. Liability
GIZMO-DEALS liability for any injury (other than death or personal injury), damage or loss, in particular consequential loss, arising from the use of any goods purchased via this site, or from the transaction itself, are hereby excluded. Any injury, damage or loss arising directly from the negligence of GIZMO-DEALS or any of its agents will be limited to a refund of the value of the goods purchased, together with any delivery charges paid.

 

These terms of sale and the supply of the goods will be subject to English law and the English courts will have jurisdiction in respect of any dispute arising from the contract. We have the right to change these terms at any time without prior agreement.

 

This policy does not affect your statutory rights.
